Terms of Service
FitCheck is an AI personal stylist: you send a photo of an outfit, FitCheck sends back feedback and the one fix that matters. These are the terms for using it. The SMS/MMS Messaging Terms are in section 5.
1. Acceptance of terms
By texting the FitCheck number, using FitCheck in your browser, or signing up for texts on our website, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use FitCheck.
2. Eligibility
You must be 18 or older and able to enter a binding agreement to use FitCheck. If you are texting from a shared or family plan, you confirm you are authorised to receive texts at that number.
3. The FitCheck service
FitCheck gives AI-generated feedback on outfits: what works, what does not, one change to make, and — where relevant — styling suggestions drawn from what you have shown it before and from real stores. It is available by SMS/MMS and in the browser. A number of free fit checks are included; we may introduce paid plans, which will be described clearly before you are charged. FitCheck may change, pause, or discontinue features at any time.
4. Your content and outfit photos
You keep ownership of the photos and messages you send. You grant FitCheck a limited licence to store and process them solely to provide the service to you, as described in the Privacy Policy. You may only send photos you have the right to share: clothing worn or laid out, by you or by adults who have consented. Do not send photos of minors, other people without their permission, sexually explicit material, or anything unlawful.
5. SMS/MMS messaging terms
Program summary
How you consent. You opt in to FitCheck texts in one of two ways: (a) by texting the FitCheck number first — your message is a request for a reply — or (b) by entering your mobile number on textfitcheck.com and ticking the unchecked consent box. Marketing and promotional texts are sent only if you tick a separate, optional box. Consent to receive texts is not a condition of any purchase. Consent is not required to use FitCheck in your browser.
Withdrawing consent. You may withdraw messaging consent at any time by replying STOP. Reply START to resume. Reply DELETE to erase your photos and messages. We keep a record of your opt-in and opt-out so we can honour them.
Keywords. STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, OPTOUT and REVOKE opt you out. START, UNSTOP and SUBSCRIBE opt you in. HELP and INFO return help. DELETE erases your data. Keywords work when sent as the whole message.
FitCheck supports major US carriers. Delivery is subject to carrier availability and is not guaranteed. A concise version of this program is at textfitcheck.com/sms-terms.
6. AI-generated recommendations
Replies are produced by an AI model. They are styling opinions, not facts; they can be wrong, and they are not professional, medical, or safety advice. Product suggestions are informational — FitCheck does not sell products, is not responsible for third-party listings, prices, or availability, and is not compensated by retailers unless stated. Wear what you want.
7. Acceptable use
- Do not send unlawful, harassing, or sexually explicit content, or photos of anyone without their consent.
- Do not attempt to reverse-engineer, scrape, overload, or interfere with FitCheck.
- Do not use FitCheck to send messages to anyone else or to impersonate FitCheck.
- There is a daily limit on how many messages a single number can send.
We may stop responding to a number that breaks these rules, and we will report unlawful content where required.
8. Intellectual property
FitCheck, its name, mark, website, and software are owned by FitCheck. You may not copy or reuse them without permission. You may keep and share the feedback FitCheck sends you for personal, non-commercial use.
9. Third-party services
FitCheck relies on third parties — mobile carriers, Twilio for messaging, Anthropic for the AI model, Supabase and Vercel for hosting — as described in the Privacy Policy. Links to retailers or inspiration are to third-party sites we do not control.
10. Disclaimers
FitCheck is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that FitCheck will be accurate, uninterrupted, or error-free.
11. Limitation of liability
To the fullest extent permitted by law, FitCheck will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or purchases you make, arising from your use of FitCheck. Our total liability for any claim will not exceed the greater of the amount you paid FitCheck in the twelve months before the claim or US$50.
12. Termination
You can stop using FitCheck at any time — reply STOP to end texts, DELETE to erase your data. We may suspend or end your access if you break these terms or if we discontinue the service.
13. Changes
We may update these terms. The date at the top is the version in force. If a change materially affects the messaging program, we will tell subscribed users by text before it takes effect. Continuing to use FitCheck after a change means you accept it.
